Introduction

Dan Martell ("we," "us," or "our") operates the Dan AI mobile application (the "App"), available on iOS and Android. Dan AI is an AI-powered coaching companion that delivers personalized business coaching based on Dan Martell's proven frameworks for scaling companies. The App is powered by Buddy Pro technology and requires an active Dan AI subscription to use. Access is granted through an activation code provided with your subscription.

This Privacy Policy explains what information we collect when you use the App, how we use and protect that information, and the choices you have regarding your data. By downloading, installing, or using Dan AI, you agree to the collection and use of information in accordance with this policy.

If you do not agree with the terms of this Privacy Policy, please do not use the App.

Section 02

Information We Collect

Information You Provide Directly

  • Account information — your name, email address, and password when you create an account.
  • Profile details — business name, industry, role, company size, and goals you provide during onboarding to personalize your coaching experience.
  • Subscription data — your Dan AI subscription is managed externally (outside the App) through third-party payment processors such as Stripe. We receive your name and email address associated with your subscription to verify your access. We do not directly collect or store your credit card number or payment details within the App.
  • Conversation content — messages, questions, prompts, voice messages, images, and files you submit to the AI coaching feature within the App.
  • Support communications — information you provide when contacting our support team at support@danmartell.com.

Information Collected Automatically

  • Device information — device model, operating system version, unique device identifiers, and mobile network information.
  • Usage data — features accessed, session duration, interaction patterns, screens viewed, and coaching topics explored.
  • Log data — IP address, access times, app crashes, and system activity.
  • Analytics data — aggregated and anonymized usage statistics to help us improve the App's performance and user experience.

Information from Third Parties

If you sign in using a third-party service (such as Apple Sign-In or Google Sign-In), we may receive your name and email address as permitted by that service and your privacy settings.

How We Use Your Information

We use the information we collect for the following purposes:

  • Provide and personalize the service — deliver AI coaching tailored to your business situation, goals, and industry using Dan Martell's frameworks.
  • Account management — create, maintain, and secure your account and manage your subscription.
  • Improve the App — analyze usage patterns, diagnose technical issues, and develop new features.
  • Communications — send service-related notifications, subscription confirmations, and respond to support requests.
  • Safety and compliance — detect, prevent, and address fraud, abuse, security risks, and technical issues.
  • Legal obligations — comply with applicable laws, regulations, and legal processes.

We do not sell your personal information to third parties. We do not use your data for advertising or marketing purposes unrelated to Dan AI.

AI Conversations & Content

The core feature of Dan AI is an AI coaching experience powered by Buddy Pro technology. When you interact with the AI coach, your messages are processed through our AI infrastructure to generate personalized coaching responses.

  • Your conversation history is stored in encrypted form using AWS DynamoDB and Pinecone. Chat content is encrypted so that our staff cannot access or read your conversations.
  • Data shared with AI providers for processing is not used to train their models.
  • We may use anonymized and aggregated conversation data to improve the quality of coaching responses across the platform.
  • Dan AI uses a shared memory system that allows the AI to retain context about you across sessions for a more personalized coaching experience. This memory is not shared with other users or exposed to third parties.
  • You may delete your conversation history at any time through the App settings.

Please avoid sharing highly sensitive personal information (such as social security numbers, financial account credentials, or health records) in your coaching conversations. The AI coach is designed for business coaching purposes only.

Section 05

Sharing & Third Parties

We may share your information with the following categories of third parties, strictly to operate and improve the service:

  • AI processing providers — including OpenAI, Anthropic, Google, OpenRouter, and fireworks.ai — to process your coaching conversations and generate responses via their APIs. Data shared with these providers is not used to train their models.
  • Cloud hosting and infrastructure — including AWS (Lambda, DynamoDB) and Pinecone — to store and serve App data securely.
  • Audio processing — Hume.ai may be used to process voice messages. Audio is processed in real time and is not stored by the provider.
  • Image generation — Fal.ai may be used when generating visual content within the App.
  • Payment processors — including Stripe — to handle subscription billing outside the App. We do not have access to your full payment details.
  • Analytics providers — to collect anonymized usage data that helps us understand how the App is used and identify improvements.
  • Legal and safety — we may disclose information if required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of Dan Martell, our users, or the public.

In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred to the acquiring entity. We will notify you via the App or email before your information becomes subject to a different privacy policy.

Section 06

Data Storage & Security

We take reasonable and industry-standard precautions to protect your personal information. Our security measures include:

  • Encryption of data in transit using TLS/SSL protocols.
  • Encryption of data at rest using AES-256 encryption via AWS DynamoDB and Pinecone.
  • End-to-end encryption of chat content — our staff cannot access or read your conversations.
  • Access controls and authentication requirements for systems that store personal data.
  • Regular security assessments and monitoring for unauthorized access.

While we strive to use commercially acceptable means to protect your personal information, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee absolute security.

Section 07

Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with the service. Specifically:

  • Account data — retained for the duration of your active account and for up to 30 days after account deletion to allow for recovery.
  • Conversation history — retained while your account is active. You may delete individual conversations or your full history at any time.
  • Usage and analytics data — retained in anonymized form for up to 24 months for product improvement purposes.
  • Support communications — retained for up to 12 months after resolution.

After the applicable retention period, data is permanently deleted or irreversibly anonymized. We may retain certain information for longer periods when required by law or for legitimate business purposes such as resolving disputes.

Your Rights & Choices

Depending on your jurisdiction, you may have certain rights regarding your personal information:

  • Access — request a copy of the personal data we hold about you.
  • Correction — request that we correct inaccurate or incomplete information.
  • Deletion — request that we delete your personal data, subject to certain legal exceptions.
  • Data portability — request your data in a structured, commonly used, machine-readable format.
  • Withdraw consent — where processing is based on consent, you may withdraw it at any time without affecting prior processing.
  • Opt out of analytics — you may disable analytics data collection through the App settings.

To exercise any of these rights, please contact us at support@danmartell.com. We will respond to your request within 30 days. We may need to verify your identity before processing your request.

Canadian Residents (PIPEDA)

If you are a resident of Canada, you have additional rights under the Personal Information Protection and Electronic Documents Act (PIPEDA), including the right to access your personal information held by us and to challenge its accuracy. European Residents (GDPR)

If you are located in the European Economic Area, you have rights under the General Data Protection Regulation including the rights described above, as well as the right to lodge a complaint with your local data protection authority.

California Residents (CCPA)

If you are a California resident, you have the right to know what personal information we collect, request deletion of your data, and opt out of the sale of personal information. We do not sell personal information.

Section 09

Children's Privacy

Dan AI is not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at support@danmartell.com and we will take steps to delete such information promptly.

Section 10

International Data Transfers

Dan Martell is based in Kelowna, British Columbia, Canada. If you access the App from outside Canada, your information may be transferred to, stored, and processed in Canada or other countries where our service providers operate.

When we transfer data internationally, we ensure appropriate safeguards are in place, including standard contractual clauses and compliance with applicable data protection laws, to protect your information regardless of where it is processed.

Changes to This Policy

We reserve the right to update this Privacy Policy at any time. When we make changes, we will revise the "Last updated" date at the top of this page and notify you through the App or by email for material changes.

Your continued use of Dan AI after the posting of changes constitutes your acceptance of the revised policy. We encourage you to review this Privacy Policy periodically.
